1. Services

Lowest Cost ELDT provides online Entry-Level Driver Training (ELDT) educational services, including course access, quizzes, progress tracking, certificates, and related support features through our website and mobile application (collectively, the "Services").

We may update, improve, modify, suspend, or discontinue parts of the Services at any time.

2. Eligibility

You may use the Services only if you can form a binding agreement under applicable law.

By using the Services, you represent that:

• the information you provide is accurate and current
• you will use the Services only for lawful purposes
• you are authorized to create and use your account
• you will not use another person's account without permission

3. Account Registration and Security

To access certain features, you may need to create an account.

You are responsible for:

• maintaining the confidentiality of your login credentials
• all activity that occurs under your account
• promptly notifying us of any unauthorized use or security issue

We may suspend or terminate accounts that appear to be unauthorized, fraudulent, abusive, or in violation of these Terms.

4. Course Access and Enrollment

When you enroll in a course, we grant you a limited, non-exclusive, non-transferable, revocable right to access that course for your personal use in accordance with these Terms.

You may not:

• share your account with others
• resell, sublicense, or transfer course access
• copy, reproduce, distribute, or publicly display course materials except as expressly permitted
• use the Services for unlawful, misleading, or abusive purposes

Course availability, access terms, and enrollment conditions may vary by course.

5. Payments and Purchases

Some Services or courses may require payment.

By purchasing a paid course or service, you agree to:

• pay all applicable fees and charges
• provide accurate billing information
• comply with any additional payment terms presented at checkout

Payments may be processed by third-party payment providers. We do not store full payment card numbers ourselves if payment processing is handled by a third party.

Any refund, cancellation, or billing terms that apply to a purchase will be shown at checkout or in a separate policy if applicable.

We may change pricing, promotions, or availability at any time.

6. Training Progress, Quizzes, and Certificates

The Services may include course progress tracking, quizzes, completion logic, and certificate generation.

You understand and agree that:

• course completion requirements may include progress, quiz, or other training criteria
• certificates may be issued only after required completion conditions are met
• training records and certificate data may be retained for operational, legal, or regulatory purposes
• successful course completion does not by itself guarantee the issuance of a CDL, employment, regulatory approval, or any government action

7. ELDT and Regulatory Reporting

Where applicable, Lowest Cost ELDT may submit training completion information to government, regulatory, or compliance-related systems in connection with ELDT program requirements.

You are responsible for ensuring that information you provide to us is accurate enough for course enrollment, identity matching, and regulatory reporting purposes.

We are not responsible for delays, rejections, mismatches, or other issues caused by incorrect or incomplete information provided by you.

8. Acceptable Use

You agree not to:

• use the Services in violation of any law or regulation
• interfere with or disrupt the Services or servers
• attempt unauthorized access to accounts, systems, or data
• upload malicious code or harmful content
• scrape, copy, reverse engineer, or misuse the Services or course materials
• impersonate another person or provide false information
• use the Services to harass, abuse, threaten, or harm others

We may suspend or terminate access for conduct that violates these Terms or harms the Services or other users.

9. Intellectual Property

The Services, including course materials, text, graphics, branding, design, software, and other content, are owned by or licensed to Lowest Cost ELDT and are protected by applicable intellectual property laws.

Except for the limited access rights granted under these Terms, no rights, title, or interest in the Services or content are transferred to you.

You may not use our name, branding, logos, or materials without our prior written permission.

10. User Content and Communications

If you submit messages, support requests, feedback, or other content to us, you grant us a non-exclusive right to use that content as reasonably necessary to:

• respond to you
• provide support
• operate the Services
• improve the Services
• comply with legal obligations

You are responsible for the content you provide and must not submit unlawful, harmful, or infringing material.

11. Third-Party Services

The Services may include links to or integrations with third-party services, such as payment providers, email services, analytics providers, or external websites.

We are not responsible for the content, policies, or practices of third-party services that we do not control.

12. Availability and Service Changes

We do not guarantee that the Services will always be available, uninterrupted, error-free, or compatible with every device or browser.

We may perform maintenance, updates, or changes at any time, with or without notice.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOWEST COST ELDT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that:

• the Services will be uninterrupted or error-free
• course content will meet every user's expectations
• regulatory systems will always accept submitted training data without delay or issue
• the Services will guarantee licensing, employment, or any specific outcome

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOWEST COST ELDT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE RELEVANT SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Lowest Cost ELDT, Novio ELD LLC, and their affiliates, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use of the Services
• your violation of these Terms
• your violation of any law or third-party right
• information or content you submit through the Services

16. Suspension and Termination

We may suspend, restrict, or terminate your access to the Services at any time if:

• you violate these Terms
• we suspect fraud, abuse, or unauthorized activity
• we are required to do so for legal, security, or operational reasons

You may stop using the Services at any time.

Sections that by their nature should survive termination will survive, including sections related to intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

17. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles, except to the extent otherwise required by applicable law.

Any dispute arising from or related to these Terms or the Services shall be handled in the courts located in Ohio, unless applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the Services after updated Terms become effective means you accept the revised Terms.
